Probate Services
Compassionate and professional probate support to guide your family through difficult times.
“With the right trust in place, some assets can pass to your family without going through probate.”
The Probate Process
When a person dies, somebody has to deal with their estate (the money, property and possessions left) by collecting in all the money, paying any debts and distributing the estate to those entitled to it.
The Probate Registry issues the document which is called a Grant of Representation. This document gives the executors or administrators the legal authority to deal with the deceased person's estate.
Steps to Administer an Estate
The probate process typically involves several key steps that must be followed carefully:
Probate Assistance
Administering an estate can be a complex, time-consuming, and emotionally draining process. Mistakes can be costly, and executors can be held personally liable for errors made during the administration.
We can act as professional executors to administer the estate on your behalf, taking the burden off your shoulders during a difficult time. Our expert team will handle all legal, tax, and administrative duties efficiently and correctly.
Our fees for this comprehensive service are typically just 1.5% of the gross value of the estate, providing exceptional value compared to traditional banks and solicitors.
1. Check if a Will Exists
The first step is to locate the original Will, if one exists. The Will names the executors who are responsible for administering the estate and outlines how the assets should be distributed.
2. Complete the Probate Form
The executors must complete the appropriate probate application forms and submit them to the Probate Registry, along with the original Will and the official death certificate.
3. Pay Inheritance Tax
If the estate is liable for Inheritance Tax, this must be calculated and paid to HM Revenue & Customs before the Grant of Probate can be issued.

4. Collect the Assets
Once the Grant of Probate is received, the executors have the legal authority to collect all the assets, close bank accounts, cash in investments, and sell property if necessary.
5. Pay Debts
All outstanding debts, funeral expenses, and estate administration costs must be paid in full before any money can be distributed to the beneficiaries.
6. Distribute to Beneficiaries
Finally, the remaining estate is distributed to the beneficiaries according to the instructions in the Will (or according to the rules of intestacy if there is no Will).
